Terms & Conditions 

These Terms & Conditions («Terms») govern the provision of private Spanish language lessons («Lessons») by ESSLINGUA, LLC («we» or «our company») to you («Student» or «you»). By booking and receiving Lessons, you agree to be bound by these Terms.

1. Services Provided
We offer private, one-on-one Spanish language instruction tailored to your individual needs and goals. Lessons may cover grammar, vocabulary, pronunciation, conversation, and cultural topics, as agreed upon between the Instructor and Student.

The policy regarding online lesson recordings for Spanish lessons (Section 5, «Recordings») does not automatically apply to ESL lessons. If an independent contractor providing ESL services chooses to record lessons, they will notify you directly, and access to such recordings will be solely at their discretion and governed by their individual terms.

2. Lesson Scheduling & Booking
Scheduling: Lessons are scheduled directly between the Administration and the Student based on mutual availability.

Booking Confirmation: A lesson is considered confirmed once both parties have agreed upon the date and time.

Lesson Packages: If purchasing a package of lessons, all lessons within the package must be used within 5 or 10 weeks from the date of purchase, unless otherwise agreed upon in writing. Unused lessons after this period may be forfeited.

3. Payment
Fees: Lesson fees will be communicated to you before booking.

Payment Due Date: Payment for individual lessons is due 48 hours before the lesson or at the end of the lesson. For lesson packages, full payment is due before the first lesson in the package.

Payment Methods: We accept payment via Zelle, check, and cash. Other forms are accepted; however, a transaction fee will be applied.

4. Cancellation & Rescheduling
Student Cancellation/Rescheduling: If you need to cancel or reschedule a lesson, please notify us by 7:00 pm the day before the class.

Cancellations or reschedules made the same day of the class will result in the forfeiture of the lesson fee.

Exceptions may be made for documented emergencies at our sole discretion.

Instructor Cancellation/Rescheduling: In the rare event that the Instructor needs to cancel or reschedule a lesson, we will provide as much notice as possible and work with you to find a suitable alternative time. ESSLINGUA will provide a substitute teacher, if available. You will not be charged for lessons canceled by the Instructor.

No-Shows: If you do not attend a scheduled lesson without prior notification, the lesson will be forfeited, and no refund will be issued.

5. Lesson Conduct & Environment
Online Lessons: For online lessons, it is your responsibility to ensure you have a stable internet connection, appropriate software (e.g., Zoom, Google Meet), and a quiet environment conducive to learning. Technical issues on your end that prevent the lesson from taking place may result in forfeiture of the lesson fee.

Recordings: All online lessons will be recorded. These recordings will be made available to you for 30 days from the date of the lesson. After this period, the recordings will be automatically deleted. These recordings are for quality control and your study and review purposes only, and may not be shared or distributed.

The policy regarding online lesson recordings for Spanish lessons (Section 5, «Recordings»)
does not automatically apply to ESL lessons. If an independent contractor providing ESL
services chooses to record lessons, they will notify you directly, and access to such recordings
will be solely at their discretion and governed by their individual terms.

In-Person Lessons: For in-person lessons, a mutually agreed-upon location will be established. We ask that you ensure the environment is free from distractions.

Respectful Conduct: Both the Student and Instructor are expected to maintain respectful and professional conduct throughout the lessons. We reserve the right to terminate lessons without refund if disruptive or inappropriate behavior occurs.

6. Refunds
Individual Lessons: Refunds are generally not provided for individual lessons once they have been paid, except in cases where the Instructor cancels a lesson and no suitable rescheduling can be arranged.

Lesson Packages: Refunds for unused lessons in a package may be considered on a case-by-case basis, subject to a cancellation fee or pro-rated calculation based on lessons already taken at the standard single-lesson rate.

7. ESSLINGUA Privacy Policy
All personal information shared by the Student will be kept confidential and will not be shared with third parties, except as required by law.

Information we collect: You do not need to provide any personal information to access our website or view the information we generally offer. To start classes, you must contact us and provide personal information such as your full name, telephone number, and email. At other times, you may be asked to provide additional information, such as your gender and age, to help us better understand our services.

Testimonials: We may publish testimonials from our clients on our websites, platforms, and social networks, which may include personal information. Once you accept the terms of service, you give us your consent to publish on our website and on social networks any testimonial or opinion that comes from you, including your name and the testimonial or opinion.

We do not share, sell, loan, or lease any of the information that you have provided us (such as name, telephone, or email address) with anyone, except if it is necessary to make transactions or provide services that you require.

What we do with your information: We may use your information to provide and improve the service. As part of the service, we can send you information about your progress and any necessary announcements for the administration of our service.

We work with third-party providers that offer services, which may include website hosting and the use of online learning materials. Personal information may be shared to give you the best possible service.

After the relationship with us ends, we may keep your information for a commercially reasonable time for audit purposes.

We use reasonable security methods to protect the information you provide to us. However, no security system is impenetrable, so we cannot guarantee the security of our servers.

By using our Website, you consent to our collection and use of your personal information as described in this Privacy Policy. We reserve the right to amend this privacy policy at any time with or without notice.

8. Disclaimer of Warranties
We strive to provide high-quality Spanish instruction. However, we do not guarantee specific results or fluency within a certain timeframe. Your progress depends on various factors, including your effort, dedication, and consistent practice outside of lessons.

9. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the lessons; (b) any conduct or content of any third party on the lessons; or (c) unauthorized access, use, or alteration of your transmissions or content.

10. Changes to Terms & Conditions
We reserve the right to update or modify these Terms at any time without prior notice. The most current version of these Terms will always be posted on www.esslingua.com/terms. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Indiana, United States of America. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in South Bend, Indiana, United States of America.
